NEC contracts are designed to promote collaboration, proactive project management and balanced risk allocation. In practice, however, they are often heavily amended. This session explores the different forms of NEC amendments, from official amendments and updates published by NEC, to bespoke Z clauses and the market-standard amendments frequently seen in public and private sector projects. We will examine common modifications that can significantly alter the balance of risk, including changes to compensation events, time bar provisions, liabilities, fitness for purpose obligations, termination rights and payment mechanisms. The session will provide practical insights into identifying key risk shifts and understanding their implications before signing the contract.
